General Terms and Conditions of Sale
Used vehicle purchase and import service from Japan (CIF)Exclusively for consumers (individuals)
Article 1 – Professional Identity

Article 2 – Scope and Role as Agent
These GTC apply exclusively to consumers. TOPRANK EUROPE acts as an agent (broker). The vehicle sales contract is concluded directly between the Client and the Japanese seller.
Article 3 – Service Description
Vehicle search (USS/TAA/JU auctions, partner stocks), translation and analysis of spec sheets, advice on risks and ratings, optional inspections (depending on pack), complete organization of export and CIF sea transport to the port of arrival, ad valorem marine insurance, coordination of Japanese transfers.
Indicative average duration: 6 to 12 weeks (variable depending on vessel availability, customs formalities, and loading times).
Not included: homologation, COC, repairs, registration, spare parts (separate quote). The GTC are provided on a durable medium (PDF).
Article 4 – Packs and Prices

An additional deposit of 5 to 20% of the target CIF budget may be requested and held in TOPRANK EUROPE's bank account.
When the vehicle's CIF price is fully paid in Japan and no cancellation has occurred, the deposit is refunded to the Client within 14 days.
Article 5 – Right of Withdrawal (14 days)
Full refund (fees + deposit) within a maximum of 14 days.
Immediate execution possible:
In case of a request for immediate execution before the deadline and subsequent withdrawal, TOPRANK EUROPE may retain an amount proportional to the services already performed (searches, translations, advice), capped at €360 (incl. VAT) (Art. L.221-25 Consumer Code).
Article 6 – Termination after the Withdrawal Period (without purchase)
As long as no vehicle has been purchased, the Client may terminate at any time.
TOPRANK EUROPE will invoice for services actually performed (searches, spec sheet translations, advice), proportionally and justified by a detailed summary.
Maximum amount: €360 (incl. VAT), deducted from the deposit. The remaining deposit balance is refunded.
No fees if fewer than 3 serious proposals.
Article 7 – Vehicle Purchase – Final Commitment
Upon successful bid or firm purchase in Japan:
• the purchase is final and irrevocable with respect to the Japanese seller,
• the Client must pay for the vehicle + Japanese fees in full and on time,
• any payment default incurs penalties for which the Client is solely responsible.
Article 8 – Re-auction (option)
Standard & Premium Packs only: in case of a change of mind post-purchase, TOPRANK EUROPE can organize a resale (€1,000 incl. VAT, up to 3 presentations, no guarantee of price or timeframe). Net proceeds remitted after deduction of actual costs.
Article 9 – Liability and Warranties
Regarding the vehicle: As TOPRANK EUROPE is not the seller, no legal warranty of conformity or warranty against hidden defects applies from its part. The vehicle is sold 'as is' according to Japanese practices. This absence of warranty does not affect any rights potentially applicable between the Client and the Japanese seller.
Regarding the agent service: TOPRANK EUROPE is responsible for the proper execution of its obligations (loyal advice, diligent inspections, CIF organization), in accordance with the Civil Code (Art. 1984 et seq.) and the Consumer Code (Art. L.111-1 et seq.). Limitation: direct damage, capped at fees received (except in cases of gross negligence or fraud).
Article 10 – Delivery and Arrival Formalities
The service concludes upon delivery to the agreed port of arrival (CIF). The Client is solely responsible for customs duties, VAT, port charges, inland transport, homologation, and registration.
