1. Purpose

These General Terms of Use (hereinafter referred to as "GTU") aim to govern the access and use of the website toprankeurope.com (hereinafter referred to as the "Site"), published by TOPRANK EUROPE (hereinafter "TOPRANK EUROPE").

By browsing the Site, the user (hereinafter the "User") acknowledges having read these GTU and accepts them without reservation.

3. Hosting

The Site is hosted by Hostinger. Production servers are located in France, with backups located in Lithuania (depending on the host's technical configuration).

4. Site Access

The Site is freely accessible to any User with Internet access. All costs related to accessing the Site (hardware, software, Internet connection, etc.) are exclusively borne by the User.

TOPRANK EUROPE reserves the right, without prior notice, to suspend, limit, or interrupt access to the Site, particularly for maintenance operations, updates, or any other technical reason.

5. Features Offered

The Site's purposes include:

• consultation of presentation content (TOPRANK EUROPE / Toprank Group);
• presentation of vehicles (in stock in France and/or Japan via Toprank stock);
• provision of contact forms;
• provision of a cost estimation simulator (import, transport, homologation, etc.).

The Site does not offer user account creation and does not, by default, constitute an online payment platform, unless expressly stated otherwise on a given page.

6. Vehicle Information: Indicative Nature

The information presented on the Site (descriptions, options, mileage, condition, availability, photos, prices, lead times, etc.) is provided as indicative and may contain errors, omissions, or approximations.

Availability: the vehicles presented may be sold without prior notice and their availability may change at any time.

Changes in specifications: vehicle characteristics and information are subject to change (updates, corrections, preparation, homologation, transport operations, or information received from third parties).

The content of the Site does not constitute a contractual offer. Only written exchanges and/or contractual documents (quotes, purchase orders, contracts) can bind TOPRANK EUROPE.

7. Cost Simulator: Non-Contractual Estimate

The cost simulator provides a purely indicative estimate, with no contractual value.

Results may vary depending on numerous parameters, including (but not limited to): applicable taxes and regulations, transport, insurance, homologation, exchange rates, external service provider costs, administrative delays, market conditions, vehicle specificities.

The User acknowledges that TOPRANK EUROPE does not guarantee the accuracy of the result provided by the simulator. For a reliable estimate, the User is invited to contact TOPRANK EUROPE to obtain a personalized study.

8. Contact Forms

The forms allow the User to submit a request to TOPRANK EUROPE. The User undertakes to provide accurate and up-to-date information.

TOPRANK EUROPE reserves the right not to respond to incomplete, clearly abusive, repetitive, or requests contrary to these GTU.

9. User Obligations – Abusive Use

The User undertakes to use the Site fairly and in compliance with current laws and regulations. Specifically, the User must not:

• impairing the proper functioning of the Site (intrusion, attempted intrusion, overload, attacks, etc.);
• collecting or extracting data from the Site automatically (scraping) without written authorization;
• disseminating via the Site (particularly via forms) any illegal, defamatory, threatening, abusive, fraudulent content or content infringing on third-party rights;
• using the Site for abusive, malicious, or harassing purposes (mass sending of requests, repeated requests, etc.).

10. Intellectual Property

The Site and each of its constituent elements (texts, images, logos, videos, graphics, database, structure, etc.) are protected by intellectual property law.

The content notably originates from the Toprank Group and may also come from external sources, partners, service providers, or be created with the assistance of digital tools (including generation/editing tools, notably AI), as applicable.

Unless prior written authorization is obtained, any reproduction, representation, modification, extraction, adaptation, or exploitation, in whole or in part, of the Site or its content is prohibited.

The Site may contain links to third-party sites. TOPRANK EUROPE exercises no control over these sites and disclaims all responsibility for their content, availability, or practices.

12. Liability – Limitation

TOPRANK EUROPE implements reasonable means to ensure access and proper functioning of the Site. However, TOPRANK EUROPE does not guarantee the absence of errors, interruptions, or anomalies.

TOPRANK EUROPE cannot be held responsible for:

• direct or indirect damages resulting from the use or inability to use the Site;
• errors, omissions, or inaccuracies in the information displayed, particularly concerning vehicles;
• the User's use of information or estimates (including those from the simulator);
• damages resulting from abusive use of the Site by the User or a third party;
• consequences related to the intervention of external service providers (transport, homologation, insurance, etc.).

13. Personal Data and Cookies

The Site uses cookies and may resort to third-party services (including audience measurement, functionalities, security, anti-spam) in accordance with User preferences and consent settings.

14. Modification of GTU

TOPRANK EUROPE may modify these GTU at any time. The applicable version is the one in force on the date of browsing the Site. It is the User's responsibility to regularly consult the GTU.

15. Language – Translations

The French version of these GTU is authoritative. Translations (notably in English and German) may be offered for indicative purposes. In case of divergence of interpretation, the French version prevails.

16. Applicable Law – Disputes

These GTU are subject to French law.

In case of a dispute relating to the use of the Site, and failing an amicable resolution, the competent courts will be those of the jurisdiction of Strasbourg, subject to applicable public policy provisions.
